Agreement to these terms

Welcome to Home AInspector (referred to herein as the "Website," "Service," "we," "us," or "our"), available at https://home-ainspector.com/en. These Terms and Conditions ("Terms") govern your access to and use of our Website, platform, and artificial intelligence-driven tools, features, and analysis services.

By accessing, browsing, or using the Service, or by uploading any information, data, or media, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are strictly prohibited from using the Service and must cease usage immediately.

The Service is an "advisory only" tool; not a substitute for professional services

1.1. AI Advisory Nature. Home AInspector utilizes advanced, experimental Artificial Intelligence (AI), machine learning models, and algorithmic generation to analyze data, text, images, or files provided by you. You explicitly acknowledge and agree that the Service functions solely as an informational, educational, and preliminary advisory tool.

1.2. Requirement to Double-Check. The outputs, reports, advice, metrics, recommendations, and information generated by the AI (collectively, "Output") are generalized approximations and may contain errors, inaccuracies, omissions, or "hallucinations." You are strictly required and expected to independently verify, audit, and double-check all Output before relying on it or taking any real-world action.

1.3. No Professional Advice. Home AInspector does not provide certified home inspections, structural engineering assessments, legal advice, financial advice, or professional architectural consults. No Output constitutes a professional guarantee, certification, or legally binding assessment of a property, contract, or situation. You must consult with a licensed, certified professional (e.g., a licensed home inspector, contractor, structural engineer, or attorney) prior to making any financial, legal, or physical commitments based on the Output.

Zero liability and "as-is" warranty disclaimer

2.1. Absolute Disclaimer of Warranties. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HOME AINSPECTOR EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SYSTEM INTEGRATION, ACCURACY, RELIABILITY, AND COMPLETENESS.

2.2. Zero Liability for Results. Home AInspector, its parent companies, affiliates, officers, directors, employees, agents, or licensors SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. This includes, but is not limited to, damages for: financial loss, lost profits, or bad investments based on AI Output; property damage, undiscovered structural/home defects, or safety hazards missed by the AI; personal injury, physical harm, or death stemming from reliance on instructions or analyses provided by the Service; and errors, data corruption, malware, or interruptions in Service functionality.

2.3. Cap on Damages. If, despite the absolute exclusions above, Home AInspector is found liable to you for any reason, you agree that our total, aggregate liability for any and all claims arising out of or related to these Terms or the use of the Service shall be strictly capped at the lesser of: (a) the total amount paid by you to Home AInspector in the three (3) months preceding the event giving rise to the liability, or (b) $100 USD.

User data content & explicit opt-in for AI training

By uploading, inputting, submitting, or transmitting data, images, text, reports, blueprints, files, or information to the Service (collectively, "User Data"), you explicitly agree to the following terms regarding data ownership and usage:

3.1. Ownership of Data. You represent and warrant that you own or have obtained all necessary licenses, consents, permissions, and rights to upload and share the User Data with Home AInspector.

3.2. Explicit Opt-In for Data Utilization & AI Training. By using the Service, you provide your explicit, unconditional opt-in and grant to Home AInspector a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to host, store, replicate, modify, process, analyze, translate, and distribute your User Data. AI Improvement and Training: You specifically authorize Home AInspector to use your User Data, anonymized logs, inputs, and corresponding outputs to train, refine, calibrate, evaluate, and improve our artificial intelligence models, algorithms, and broader machine-learning systems.

Privacy Consideration: Any usage of personal data within your User Data will be subject to our Privacy Policy. However, to the extent that you input data, you grant us the right to fully anonymize or de-identify said data and use it indefinitely for commercial and developmental purposes.

Acceptable use and restrictions

You agree that you will not use the Service to: upload documents, images, or data belonging to properties or individuals for which you do not have explicit authorization or legal rights to inspect/analyze; reverse engineer, decompile, crawl, scrape, extract data from, or attempt to derive the source code or underlying architecture of Home AInspector's AI models; input content that is fraudulent, defamatory, obscene, invasive of privacy, or infringing upon the intellectual property of others; or automate interactions with the Website via unauthorized bots, scripts, or API extensions unless expressly permitted in writing by us.

Indemnification

You agree to defend, indemnify, and hold harmless Home AInspector, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms, (b) your misuse of the Service or its Output, or (c) any claims that your User Data violated the privacy or intellectual property rights of a third party.

Termination

We reserve the right, in our sole discretion and without notice, to terminate or suspend your access to all or part of the Service, remove any User Data, or discontinue features for any reason, including without limitation, breach of these Terms, security risks, or commercial unviability.

Governing law and dispute resolution

7.1. Governing Law. These Terms, and all claims or causes of action arising out of them, shall be governed by and construed in accordance with the laws of [Insert State/Country, e.g., the State of Delaware, USA], without giving effect to any principles of conflicts of law.

7.2. Mandatory Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by [Insert Arbitration Body, e.g., the American Arbitration Association (AAA)] in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. You waive your right to participate in class-action lawsuits or class-wide arbitration.

Changes to these terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes.
